1. Scope
These Terms & Conditions apply to all contracts between

(hereinafter "Seller") and customers who place orders through the online store neckcloud.store.
Deviating terms and conditions of the customer are not accepted unless the Seller expressly agrees to them in writing.
2. Formation of Contract
The display of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order. By submitting the order via the "Buy Now" button, the customer makes a binding offer to purchase the products in their shopping cart.
The contract is concluded as soon as the Seller confirms the order by email or ships the goods. An automatically generated order confirmation does not constitute acceptance of the offer.
3. Prices and Taxes
All prices shown are final prices in USD. Customs duties and/or import taxes may be charged upon delivery and are the responsibility of the customer (see Section 6).
4. Payment
Accepted payment methods: Credit card (Visa, Mastercard), PayPal, Klarna, Apple Pay, Google Pay. Payment is due immediately upon completion of the order.
5. Delivery, Shipping & Fulfillment
The Seller operates on a dropshipping model. Storage and shipping are handled by fulfillment partner Zendrop. Company Sidler remains the sole contractual partner and first point of contact for all questions and complaints.
Delivery typically takes 6–12 business days after payment. Products are generally shipped from China or, in some cases, from the USA. All shipments include tracking.
6. Customs & Import Duties
Customs duties and/or import taxes may apply depending on the destination country. These are determined by the local customs authority and are the responsibility of the buyer. The Seller accepts no liability for customs charges.
7. Right of Withdrawal (EU consumers)
Consumers residing in an EU member state have the right to withdraw from this contract within 14 days without giving any reason, from the day they receive the goods. To withdraw, contact: contact@neckcloud.store
Upon withdrawal, the Seller will refund all payments within 14 days of receiving the withdrawal notice, using the same payment method. Return shipping costs are borne by the customer.
8. Retention of Title
Delivered goods remain the property of the Seller until the purchase price has been paid in full.
9. Warranty
Statutory warranty rights apply. For EU consumers, the warranty period is 2 years from delivery. For defects, contact contact@neckcloud.store with a description and photos.
10. Limitation of Liability
The Seller is only liable for damages in cases of intent or gross negligence. The product is not a medical device and does not replace medical treatment. Use at your own risk; consult a doctor if you have health concerns.

12. Online Dispute Resolution (EU)
The European Commission provides an ODR platform: ec.europa.eu/consumers/odr. We are not obligated to participate in arbitration proceedings but always strive for an amicable resolution. Contact: contact@neckcloud.store
13. Governing Law & Jurisdiction
Swiss law applies, excluding CISG. Mandatory consumer protection provisions of the customer's country of residence remain unaffected. Place of jurisdiction for merchants: Lucerne, Switzerland.
14. Severability
Should any provision be invalid, the remaining provisions remain in force. The Seller reserves the right to amend these Terms at any time.
